Technical Specifications for Interoperability


Interoperability constitutes the technical harmonisation in the railway sector so that the progressive opening of market according to the Directive 91/440/EC is achieved. The adaptation of Greek legislation to the provisions of Directive 2008/57/EC (Interoperability Directive) has been made with the presidential decree 104 (Official Gazette of the Hellenic Republic A’ 181/12.10.2010) entitled «Harmonisation of Greek Law to the provisions of the Directive 2008/57/EC of the European Parliament and the Council of 17 June 2008, on the interoperability of the rail system within the Community, and of the Commission Directive 2009/131/EC of 16 October 2009 amending Annex VII to Directive 2008/57/EC».
 
Council Directive 96/48/EC on the interoperability of the trans-European high-speed rail system and Directive 2001/16/EC on the interoperability of the trans-European conventional rail system were substantially amended by Directive 2004/50/EC. As new amendments are introduced by Directive 2008/57/EC, Directives 96/48/EC & 2001/16 are recasted in the new Directive 2008/57/EC and in the relevant presidential decree 104/2010, for the sake of clarity and their provisions are merged together into a single instrument with a view to simplification. The presidential decree 159/2007 is repealed from entry into force of presidential decree 104/2010 (with effect from 19 July 2010).
 
In the Ministerial Decision ΑΣ16.4/οικ.24863/2723 (Official Gazette of the Hellenic Republic Β’ 1812/08.06.2012), the procedure, the documents to be submitted as well as any other relevant details, regarding the submission of application for the authorisation of placing in service of rail subsystems, rail vehicles or series of rail vehicles, have been defined.
 
The scope of the interoperability directive covers the conventional trans-European networks as well as the high-speed trans-European networks, as these are defined in the decision 1692/96/EC as in force, on Community guidelines for the development of the Trans-European Transport Network, as well as the vehicles that can operate in these networks. The scope of the Directive will be extended progressively to cover the entire network and all vehicles, on the condition that the relevant economic feasibility will be shown via impact assessment.
 
 The presidential decree 104/2010 aims at establishing the requirements to be met so that interoperability within the Community rail system is achieved in line with the provisions of Directive 2004/49/EC. These requirements cover the aspects of the design, construction, placing in service, upgrading, renewal, operation and maintenance of the parts of this system as well as the professional qualifications and health and safety conditions of the staff that contribute to its operation and maintenance.
 
The pursuit of this objective must lead to the definition of an optimal level of technical harmonisation and:
(a) facilitate, improve and develop international rail transport services within the European Union and with third countries;
(b) contribute to the progressive creation of the internal market in equipment and services for the construction, renewal, upgrading and operation of the rail system within the Community;
(c) contribute to the interoperability of the rail system within the Community.
 
In order to ensure the interoperability of the rail system, technical specifications of interoperability (TSIs) are worked out by the European Railway Agency for each subsystem or department of subsystem according to the provisions of the directive. The rail system is subdivided into structural subsystems (infrastructure, energy, control-command and signalling, rolling stock) and into functional subsystems (traffic operation and management, maintenance, telematic applications etc.). The structural subsystems have to conform to the TSIs when they are put in place, or are renewed and upgraded. The above conformity is maintained continuously at all period of use of the subsystem. The TSIs that have been published are presented in the following table. The structural subsystems constituting the rail system are subjected to a verification procedure, which enable the National Safety Authority (Department of Railway Safety) responsible for authorising their placing in service to be certain that, at the design, construction and putting into service stages, the result is in line with the regulations and technical and operational provisions in force. These structural subsystems are considered to be interoperable only if they are accompanied by an “CE” declaration of verification.
 
It has to be noted that according to the presidential decree 104/2010, the notified bodies that are in charge to apply the “CE” verification or conformity and suitability procedure have to be accredited by E.SY.D. (National Accreditation System).
 
The general principle that one authorisation is sufficient for the whole Community rail network is established. Furthermore, the procedure for authorising vehicles, which are TSI conform is simpler and quicker than in the case of non-TSI conform. The principle of mutual recognition is also applied as far as possible: when a vehicle has already been placed in service in one Member States, other Member States should not invoke national rules to impose unnecessary requirements and redundant verifications, unless these are strictly necessary for verifying the technical compatibility of the vehicle with the relevant network. Finally, prescribed time limits are defined for a national safety authority to take a decision on the placing a service for a vehicle, which has been already authorised to be placed in service in another Member State.
 
With the Commission Decision 2010/713/EU of 9 November 2010, the modules for the procedures for assessment of conformity, suitability for use and EC verification to be used in the technical specifications for interoperability adopted under Directive 2008/57/EC of the European Parliament and of the Council were defined.

The national rules for the authorization of placing rolling stock in service in Greece have been included in the National Reference Document, which has been notified to the European Railway Agency.

The Department of Railway Safety is also competent for the approval of internal combustion engines installed on rail vehicles (emissions of gaseous and particulate pollutants) in the context of the joint ministerial decision Δ13/0/121 (Official Gazette of the Hellenic Republic Β’ 53/24.06.2007), as amended with the joint ministerial decision Δ13/Ο/3967 (Official Gazette of the Hellenic Republic Β’ 741/05.05.2011).
